Welcome to Calcutta Fresh Foods. These Terms of Service ("Terms") govern your access to and use of our mobile application, website, and services. By placing an order with us, you agree to be bound by these Terms.

 

 

1. About Calcutta Fresh Foods

Calcutta Fresh Foods is a fresh fish and meat delivery service operating in select locations of Kolkata. We specialize in delivering freshly sourced products to customers every morning.

 

 

2. Eligibility

  • You must be at least 18 years of age to place an order.

  • By using our services, you confirm that the information provided by you is accurate and complete.

 

 

3. Service Model

  • All products are fresh, perishable food items.

  • Orders are prepared early morning on the day of delivery.

  • Delivery is scheduled between 7:00 AM and 12:00 PM for orders placed the previous night.

 

 

4. Order Placement & Acceptance

  • Orders can only be placed for next-day morning delivery.

  • Once an order is placed and confirmed, it is considered final.

  • Calcutta Fresh Foods reserves the right to accept or reject any order at its discretion.

 

 

5. No Cancellation & No Refund Policy

  • Orders once placed cannot be cancelled.

  • Due to the perishable nature of fish and meat, cancellations, returns, or exchanges are not permitted.

  • Refunds are only applicable under our Freshness Assurance Policy (see Section 8).

 

 

6. Pricing & Payments

  • All prices are displayed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.

  • Payments must be completed at the time of order placement.

  • We reserve the right to change prices without prior notice.

 

 

7. Delivery

  • Deliveries are attempted once per order.

  • Customers must ensure availability at the delivery address during the delivery window.

  • Failure to receive the order may result in forfeiture without refund.

 

 

8. Freshness Assurance – “Either It’s Fresh or It’s Free”

  • If you receive a product that does not meet our freshness standards, you must notify us within 2 hours post delivery.

  • Claims may require photo or video evidence.

  • Upon verification, a replacement or refund may be issued at our sole discretion.

 

 

9. Product Weight & Variations

  • Natural variations in weight, size, and appearance may occur.

  • Final billed weight may vary due to cleaning, cutting, and processing.

 

 

10. User Responsibilities

You agree not to:

  • Misuse the platform or provide false information

  • Engage in abusive behavior with delivery personnel

  • Use the service for any unlawful purpose

 

 

11. Limitation of Liability

  • Our liability is limited to the value of the order placed.

  • We are not responsible for indirect, incidental, or consequential damages.

 

 

12. Force Majeure

We shall not be liable for delays or failures caused by events beyond our reasonable control, including but not limited to weather conditions, strikes, or governmental actions.

 

 

13. Changes to Terms

Calcutta Fresh Foods reserves the right to modify these Terms at any time. Continued use of the service constitutes acceptance of the updated Terms.

 

 

14. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. Courts in Kolkata, West Bengal shall have exclusive jurisdiction.
